 Today is deeming day

The US Food and Drug Administration’s final Deeming Rule regulations, which take effect today, extend the agency’s regulatory authority to cigars, pipe and hookah tobacco, and electronic vapor products, according to a MedPage Today story relayed by the TMA.

The measure bans the sale of these products to people under 18 years of age; requires retailers to check the photo ID of customers who appear to be under the age of 27; prohibits the sale of these products in vending machines, except in facilities that do not allow people under the age of 18 on the premises; and it outlaws the free distribution of these products.

The measure prohibits the marketing of modified-risk tobacco products without the approval of the FDA; and mandates that manufacturers of newly deemed products obtain premarket authorization through substantial equivalence.

Products on the market as of today will be given additional time to comply with certain submission requirements, such as ingredient listing, health document submission and premarket tobacco applications.
